AILCD Warranty and Refund Policy as outlined in
this document warrants that its goods and services are of merchantable
quality and are suitable for its designed purpose. In the unlikely
event of receiving goods that do not meet the standards of merchantable
quality and fitness for designed use and purpose, it is AILCD’s
express desire that such goods are returned and are replaced. |

If through unintended misrepresentation
of a product in our advertising, the product does not meet the
expected needs of the client a full refund is given. It is also
appreciated if the point of alleged misrepresentation is made
clear at the point of claim. |

The following definitions and procedures
guide you through the understanding of our claims process. |

1.Definitions "Goods":
are tangible products that are purchased from the AILCD ecommerce
store or directly from AILCD. "Services":include
but not limited to consultations, seminars, courses, training
programs, assessments and advice information downloads.
"Fitness for purpose": refers to the functional
features of the product itself that allows the product to effectively
function but does not include the capacity of the individual
to use or comprehend the use of the product. If it is deemed
that a person of average ability is able to comprehend and follow
the instructions for the use of the product- the product is
fit for it's purpose. "Merchantable quality":Is
the quality that is generally accepted in the market place for
that type of product and that it is able to fulfill the use
for which it has been designed and or advertised. "Defective":
the product is not functioning in the expected manner as designed
by the manufacturer. In other words, there is a fault with the
product. |

2.The Claims Procedure |

The following procedure is required
in order to take advantage of the claims facility. Note: the
SAME procedure is required whether or not you have your receipt.
Claiming Warranty for Goods:
You must present your receipt to prove that you have in fact
received the service or goods from AILCD.
If you have received goods, the goods must be presented with
a down loadable form, filled out, indicating the fault with
the product, in the space provided.
In the space provided, you must indicate whether you wish to
receive a replacement or a refund etc. Claiming
Warranty for a Service
If you are claiming warranty for a service, you must fill in
the down loadable form to claim warranty. On the warranty claim
form, you must indicate if the fault with the service was due
to the service:
- Not being provided with due care
- Not being provided with due skill
- Resource materials provided, not being fit for purpose

Conditions: When returning
goods without your receipt, we require suitable identification
such as a Driver’s Licence or any other form of identification
that contains your name, address, signature and photo such that
we can match these against our customer purchase records. Where
your proof of identity matches our records, the claim will be
handled according to the above procedure. In the event that
your proof of identity does not match our records, we regret
that no refund, exchange, voucher or repair will be able to
occur.
A mere statement, regarding the issues above, without evidence
is not accepted as a claim for warranty. The issues of both
skill and care must be associated with what is reasonably expected
in return for the fee paid and the associated time expected
to be spent for that fee. If the service claim is advice only,
then the onus is on the client to carry out that advice in order
to gain result. If the service claim is complete therapeutic
outcome, then the responsibility is upon the therapist. But,
the extent of warranty is only to the extent of the claims made
by the therapist, in writing, before the therapy takes place.
Resource materials, if not fit for purpose must be remedied
and reissued.

(i) Goods |

Downloadable products
“Downloadable products” include, but are not limited
to, documents, instructions, software, worksheets, training
programs and other items made available to Users electronically
via our website.
Due to the nature of downloadable products, no refunds will
be generally provided except for proven unfitness for purpose
or intentionally misleading or invalidated information that
is not able to be remedied. |

- If the product is found to be defective or faulty, we
will replace the downloadable product with a functional
copy of THE SAME product
- If the design of the product is in itself proven to be
unfit for the purpose, not of merchantable quality, or does
not match any description or sample given in promotional
material, on the website, on labeling or packaging, we will
refund the client.
Physical products "Physical products" are tangible
products distributed to Users from our authorized offices, distributors
or outlets and may include, but are not limited to, CDs, DVDs,
training materials, toys & games, instructions, manuals, and
other such tangible items.
If you return the product unopened, we will provide you a direct
refund, a choice of an alternate product or a credit voucher
to purchase goods to the value of the receipt, at another time.
If the product is opened but the product has proven to be faulty,
at our discretion, we may either repair the product or replace
the faulty product with a functional copy of THE SAME product
or offer you an exchange for a product of similar value or refund.
If the product is opened and has proven to be unfit for the
purpose or of unmerchantable quality or does not match any description
or sample provided in promotional material, on the website,
or on labeling or packaging, we will provide you with your choice
of either: a full refund, exchange for another product of similar
value, or a credit voucher to the value of the product on the
day it was purchased. |

AILCD is not a medical organisation, and does
not provide medical advice or diagnosis. Although AILCD provides
therapeutic strategies, nothing on the Website should be construed
as advice or diagnosis. The materials, information and reports
generated by AILCD should not be interpreted as a substitute
for medical consultation, evaluation, or treatment by a qualified
doctor. The Website is intended only for the use of healthy
adults. |

Operating difficulties
If you experience any operating difficulties with software programs,
please contact the manufacturer. The manufacturer provides a
help facility to assist the correct operation of the product.
However, if the product operation difficulty arises out of learning
difficulties, the client has the option of booking in for a
paid consulting session or a series of consulting sessions with
the view of assisting the operation of the product.

(ii) Services "Services"
include, but are not limited to, consultations, seminars, courses,
training programs, assessments (tests) etc. Exchange
for Services
- If you contact us up to 24 hours BEFORE the service will
be delivered, arrangements for the delivery of the service
at a different time (to be negotiated, subject to availability)
or for a substitute participant will be made at no extra
charge.
- If you contact us LESS THAN 24 hours before the service
will be delivered to make arrangements for the delivery
of the service at a different time (to be negotiated, subject
to availability), or if you fail to meet the agreed appointment,
we will charge an administration fee of $25.00 (AUD).

Cancellation
& Refund Policy for Services: |

- All Services will be refunded in full ONLY if you cancel
your appointment four (4) or more working days before the
Service will be used.
- If you cancel your appointment less than four (4)
working days BEFORE the service will be delivered, we
will charge a cancellation fee of $25.00 (AUD).
- No refunds will be provided for Services after you have
commenced, completed or "used" the Services except where
services were not provided with Due Care and Skill
- If any of the materials provided as part of the Service
are not fit for the purpose or are defective or faulty,
these will be replaced or exchanged at no charge to you.
- AILCD reserves the right to cancel services due to insufficient
enrolments (for group services) or due to other circumstances
beyond our control. In such a case, AILCD will provide you
with your choice of either a full refund or exchange for
services to the same value. AILCD will not accept any responsibility
for travel or accommodation costs incurred.
If extenuating circumstances, such as misadventure, prevent
you from attending your appointment for the Service, exchange
or cancellation will be provided without penalty.
NOTE: ALL SERVICES ARE SUBJECT TO THE MOST UP-TO-DATE EDITION
OF OUR DISCLAIMER STATEMENT AS PUBLISHED ON OUR WEBSITE. |
